Terms of Service

These Terms of Service ("Terms") govern your use of the MotoMart JA platform (the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and legally able to enter into contracts under Jamaican law to use the Platform. By registering, you confirm that you meet these requirements.

2. Account & Verification

You must provide accurate information during registration and complete identity verification before placing bids or listing vehicles. You are responsible for keeping your account credentials secure and for all activity under your account.

3. Bidding & Auctions

All bids are binding. Once you place a bid, you cannot retract it. If you win an auction, you are obligated to complete the purchase. Funds may be placed on hold in your wallet when you bid. Winning bidders who fail to complete payment may be subject to penalties and account suspension.

4. Buy Now & Offers

"Buy Now" listings allow immediate purchase at the listed price. Offers may be submitted on eligible listings and are subject to seller acceptance. Accepted offers create a binding purchase obligation.

5. Selling Vehicles

Sellers must own the vehicle, have the right to sell it, and provide accurate descriptions, photos, and documentation. All listings are subject to admin review and approval. Misrepresentation may result in listing removal, account suspension, and forfeiture of proceeds.

6. Payments & Wallet

Wallet deposits are processed through approved payment channels. Seller payouts are issued after a successful transaction and any applicable dispute period. MotoMart JA may charge fees for certain services, which will be disclosed before you complete a transaction.

7. Disputes

Buyers may open a dispute if a vehicle does not match its listing. Disputes are reviewed by our team, and resolutions may include refunds, partial refunds, or dismissal. Our decision on disputes is final.

8. Prohibited Conduct

• Shill bidding, bid manipulation, or using multiple accounts to influence auctions.
• Listing stolen, fraudulent, or encumbered vehicles.
• Attempting to transact outside the Platform to avoid fees.
• Harassing other users or misusing the messaging system.

9. Limitation of Liability

MotoMart JA acts as a marketplace facilitator. We are not a party to transactions between buyers and sellers and are not liable for the condition, title, or performance of any vehicle. Our liability is limited to the maximum extent permitted by Jamaican law.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
